Against the backdrop of an incredibly challenging year for the global maritime industry this publication from our CMS Shipping team examines a number of key aspects of the shipping industry pushed into the spotlight by the COVID-19 pandemic. We take a look at the outbreak of the COVID-19 pandemic and its immediate impact on shipping and include a guide to the English law position on force majeure and an overview of some of the state aid offerings currently in existence (with a focus on Germany’s aid for its indigenous yards). The team gives its perspective on the impact of the pandemic on Asian shipyards, and we examine the consequences of Brexit on the shipping industry and the increasing cyber risk present in the maritime context as a result of the increased digitisation of the industry consequent on the lockdowns. We then shift our attention to sustainability, a topic of growing importance in the maritime sector, including an exploration of the parallel progress being made in sustainable ship finance and looking ahead to the green legislation that is coming round the corner.
