1. What are the key changes to Bosnia and Herzegovina’s product liability laws following the updated EU directive, if applicable.
Bosnia and Herzegovina has signed a Stabilization and Association Agreement with the European Union in 2008.
In 2022 the European Union granted member candidate status to Bosnia and Herzegovina, and in 2024 the European Commission recommended opening membership talks with Bosnia and Herzegovina.
Therefore, it is expected that Bosnia and Herzegovina will align its legislative framework with European Union Law in the next years prior to joining the European Union, although the timeline on this is unclear.
2. Has any specific case law evolved?
No specific case law has evolved and matters are dealt with mostly on a case-by-case basis by the relevant courts or consumer protection bodies.
3. Are there any aspects of the directive that are subject to varied interpretations or pose particular legal challenges in Bosnia and Herzegovina?
